2. Products & Services
Runfish Apparel provides OEM and ODM manufacturing services for fishing apparel and accessories, including but not limited to:
- Custom fishing shirts, hoodies, jackets, pants, shorts, and vests
- Fishing accessories such as hats, gloves, neck gaiters, socks, and waders
- Performance fabrics with UPF50+ sun protection, quick-dry, and moisture-wicking technologies
- Full customization services including fabric selection, printing, embroidery, labeling, and packaging
Product images on our website are for reference purposes. Actual products may vary slightly in color, texture, or appearance due to screen display differences and manufacturing processes. We recommend requesting physical samples before placing bulk orders.
3. Ordering & Pricing
- All prices quoted are in US Dollars (USD) unless otherwise specified and are subject to change based on order specifications, quantities, fabric choices, and customization requirements.
- A formal quotation is valid for 30 days from the date of issue unless otherwise stated.
- An order is confirmed only after both parties agree on specifications, pricing, and delivery terms, and the required deposit has been received.
- We reserve the right to adjust pricing if raw material costs fluctuate significantly after the initial quote.
4. Minimum Order Quantity (MOQ) & Samples
- MOQ: Our standard minimum order quantity starts from 50 pieces per style per color. MOQ may vary depending on the product category and customization complexity.
- Samples: We offer sample production services. Sample lead time is typically 5-7 business days. Sample fees may apply and are generally deducted from the bulk order payment upon confirmation.
- Pre-Production Samples: For bulk orders, we provide a pre-production sample for final approval before mass production begins. Production will not proceed until written approval is received.
5. Payment Terms
- Deposit: A deposit of 30%-50% of the total order value is required to initiate production. The exact percentage will be specified in the proforma invoice.
- Balance Payment: The remaining balance is due before shipment, upon presentation of production completion photos and quality inspection results.
- Payment Methods: We accept payment via bank transfer (T/T), PayPal, and other mutually agreed methods.
- Currency: All transactions are conducted in USD unless otherwise agreed in writing.
6. Shipping & Delivery
- Production Lead Time: Standard production takes 20-35 business days after sample approval and deposit receipt. Lead times may vary based on order volume and complexity.
- Shipping Methods: We ship via sea freight, air freight, or express courier (DHL, FedEx, UPS) depending on order size and urgency.
- Shipping Terms: Unless otherwise agreed, orders are quoted on an FOB (Free on Board) basis from our factory location. CIF and other Incoterms arrangements are available upon request.
- Delivery Delays: While we make every effort to meet delivery timelines, we are not liable for delays caused by force majeure events, customs clearance, or circumstances beyond our control.
7. Returns & Warranty
- Quality Guarantee: All products undergo quality inspection before shipment. We guarantee that goods will conform to the approved sample specifications and agreed quality standards.
- Defective Goods: If goods are found to be defective or not conforming to approved specifications, you must notify us in writing within 14 days of receipt with supporting photos and documentation. We will work with you to resolve the issue through replacement, repair, or partial refund.
- Non-Returnable Items: Due to the custom nature of OEM/ODM products, returns for non-defective goods (e.g., change of mind, incorrect order specifications provided by the buyer) are generally not accepted.
- Claims: Any claims for shortages or damages during shipping must be filed with the shipping carrier. We recommend purchasing shipping insurance for all orders.
8. Intellectual Property Rights
- All content on our website, including text, images, graphics, logos, and page layouts, is the intellectual property of Runfish Apparel and is protected by applicable copyright and trademark laws.
- Designs, logos, brand names, and artwork provided by clients for OEM/ODM production remain the intellectual property of the respective client. We will not use, reproduce, or disclose client-provided designs to third parties without written consent.
- Clients warrant that all designs and materials provided for production do not infringe upon any third-party intellectual property rights. Clients agree to indemnify Runfish Apparel against any claims arising from intellectual property infringement related to client-provided materials.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- Runfish Apparel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or services.
- Our total liability for any claim related to an order shall not exceed the total amount paid by you for that specific order.
- We are not liable for losses resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, supply chain disruptions, or other force majeure events.
This website and its content are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of website content.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising from or in connection with these Terms or our business relationship shall be resolved through the following process:
- Negotiation: Both parties shall first attempt to resolve any dispute through friendly negotiation within 30 days of written notice.
- Arbitration: If negotiation fails, the dispute shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration in accordance with its rules. The arbitration shall take place in Shenzhen, China. The language of arbitration shall be English.
